Surrogacy Conditions in India For OCI Cardholders

Are you ready to experience parenting and have your own child in India? Yes, it is feasible as per the Assisted Reproduction Technology (ART) and Surrogacy Bill 2021 regulated By the Lok Sabha of India. However, if you have an OCI card, you must follow certain rules in order to go through the Surrogacy process in India. It is relatively simple to pursue surrogacy in India if both partners have Indian citizenship. However, if one has Indian citizenship and the other has another country's citizenship or is an OCI Cardholder, the documentation will be that of the Indian citizen.

Guidelines Applicable for OCI Cardholder

OCI/PIO Cardholders are subject to certain conditions. As a result, if you are considering contracting surrogacy in India, you should be familiar with the following provisions. OCI/PIO cardholders visiting India for commissioning surrogacy will not be required to obtain a specific Medical Visa. When you arrive in India prior to surrogacy, you must request specific authorization from the FRRO/FRO. This clearance will be provided to you for the issue in question if you match the following criteria:

• The couple should be married and have been together for at least 5 years.
• Assign a letter from the foreign country's embassy in India or an application from the country's foreign ministry stating that their respective country recognises surrogacy and that the born child would be regarded as the biological child of the couple contracting surrogacy and will be allowed to enter their country.
• The couple must provide written assurance that they will care for the child born through surrogacy.
• The treatment should be carried out at ICMR-approved ART clinics.
• The applicant pair should have a signed agreement with the Indian surrogate mother.
